چکیده

دیدگاه‌‌های گوناگونی دربارۀ سقط جنین، از منظر اخلاقی، طرح شده است. برخی بر آنند که سقط جنین، به لحاظ اخلاقی، از لحظه لقاح مطلقاً نادرست است. حتی در صورتی که جان مادر در معرض خطر باشد؛ در مقابل، عده‌‌ای معتقدند نه تنها سقط کردن جنین در طول مدت بارداری نادرست نیست، بلکه کشتن نوزاد تازه متولد شده نیز نادرست نیست. گروه سوم قائل به تفصیل‌‌اند: برخی سقط جنین را در صورتی مجاز می‌‌دانند که جان مادر در معرض خطر باشد؛ برخی میان مراحل مختلف بارداری تفاوت قائل شده‌‌اند؛ برخی میان بارداری خواسته و ناخواسته تفاوت قائل شده‌‌اند و در صورتی که بارداری ناخواسته باشد سقط جنین را مجاز دانسته‌‌اند و در صورتی که بارداری با خواست مادر باشد تنها در صورتی سقط جنین مجاز است که جان مادر در معرض خطر باشد و ... . جودیث جارویث تامسون تفصیل اخیر را مطرح کرده ‌‌است. وی برای نخستین بار در مقاله‌‌ای که در سال 1971م. نوشت میان بارداری خواسته و ناخواسته تفاوت قائل شد و سقط جنین را در صورتی که بارداری ناخواسته باشد، مجاز دانست. در این مقاله، به نقد و بررسی بخشی از ادعای تامسون در این زمینه پرداخته می‌شود.

Different views have been raised about the moral aspects of the abortion. Some people hold that abortion is morally wrong from the moment of conception, even if the mother’s life is in danger. On the other hand, some people believe that abortion is not wrong throughout the pregnancy and above that, killing the infant is not wrong either. A third party makes a distinction here: some of them see abortion as legitimate if the mother’s life is in danger, some have made the distinction in different phases of pregnancy and regard it as legitimate in some early phases; some others maintain that abortion is legitimate if the pregnancy was unwanted, and where the pregnancy is wanted, they only allow abortion in case the mother’s life is in danger, … . Judith Jarvis Thomson has proposed the last distinction. She distinguished between unwanted and wanted pregnancy for the first time in her 1971 paper and regarded it as legitimate when unwanted. In this paper, I will deal with the examination of part of the Thomson’s claim.
